Information on data protection

Thank you for submitting your job application to FOBOHA (Germany) GmbH. The protection of your personal information is very important to us. With this data protection notice, we would like to inform you about our handling of your personal data and your associated rights.

I. Data collected, purpose and legal basis of processing
We process the data you provide as part of the online application process (such as master data, contact data, curriculum vitae, certificates, qualifications, etc.) in order to be able to make a decision on your application. This means that, depending on the job being advertised, it is necessary for you to make certain personal data available to us.
Your data are provided voluntarily in accordance with Article 6 (1) (a) of the General Data Protection Regulations (GDPR). The legal basis for the processing of your data as part of the decision-making process regarding your application is thus Article 6 (1) (b) of the GDPR. We may also process personal data in order to be able to meet legal obligations (see Article 6 (1) (c).

II. Data transfer and recipients
This online job application system facilitates carrying out and processing the application process as a whole. It is operated by Haufe-Lexware Services GmbH & Co. KG for all companies within FOBOHA (Germany) GmbH. As a result, all companies belonging to FOBOHA (Germany) GmbH have access to your application data.
In addition, we may pass on your data to service providers and partners (e.g. computer center operators and infrastructure service providers) who are assisting us (technically and organizationally) in carrying out the application process. In this regard we have entered into processor agreements with our service providers in accordance with Article 28 of the GDPR.

III. Third-country transfers and guarantees
The technical infrastructure of this online application tool is operated and managed in Germany and Switzerland. It is thus possible that your data could be transferred to a so-called “third country,” i.e., a country outside the European Economic Area (EEA). Specific legal agreements have been concluded to cover this.

IV. Storage period and storage duration
Your data will only be processed or saved in the online application system for the period of the ongoing application process.
If the application process ends successfully with a job placement, your data will be transferred to the HR Master Data. If you are not hired and do not consent to the transfer of your data to the “talent pool,” your data will be anonymized within 6 months of completion of the application process.

V. Consent to transfer of the data to the FOBOHA GmbH talent pool
If your application is not successful, we can add your data to our “talent pool,” provided you give us your consent.
In this way your data are available to all companies of FOBOHA (Germany) GmbH for further employment opportunities. Data are deleted there at the latest after two years, unless you renew your consent or withdraw your consent.
You will be informed about how you give your consent for storage of your data in the FOBOHA (Germany) GmbH talent pool in the course of the e-mail correspondence regarding your application.

VI. Your rights

1. The right to object to processing:
You can withdraw consent related to future processing of your personal data at any time.

2. The right to access:
You can require at any time that we provide you information regarding what personal data we are processing and how, see Article 15 of the GDPR.
3. The right to rectification:
You can require correction of incorrect personal data and completion of incomplete personal data, pursuant to Article 16 GDPR.

4. The right to erasure/anonymization:
To delete/anonymize your personal data: Please note, deletion/anonymization excludes data that we need for the execution and processing of contracts and for the establishment, exercise and defense against legal claims, as well as data for which statutory, regulatory or contractual retention obligations exist (Article 17 GDPR).

5. The right to restrict processing:
Under certain circumstances, you can request that processing be restricted, e.g. if you are of the opinion that your data are incorrect, if the processing is unlawful or if you have objected to the data processing. This means that your data may only be processed to a very limited extent without your consent, such as to assert, exercise and defend against legal claims or to protect the rights of other natural and legal persons (Article 18 GDPR).

6. Objection to data processing:
You have the option to object to the processing of your data at any time. In addition, if there are special reasons, you can object at any time to data processing on the basis of a legitimate interest ( Article 21 GDPR).
Please direct your objection to processing within the application process to your contact person at FOBOHA (Germany) GmbH within the application process.

7. The right to data portability:
You have the right to receive the data that you have provided to us and that we are processing on the basis of your consent or for the fulfillment of a contract in a commonly used and machine-readable format and, within the scope of what is technically feasible, to request that this data be transmitted directly to third parties (Article 20 GDPR).

8. Right to lodge a complaint with the supervisory authority:
If you are of the opinion, for example, that our data processing is illegal or we have not granted the rights described above to the extent necessary, you have the right to lodge a complaint with the competent data protection supervisory authority.

9. Self service:
You can also update your information in the online application system or delete your interactive applicant file at any time.

VIII. Data security:
The online application process uses a secure transmission process that is supported by most browsers. All information transmitted using this method is encrypted before it is sent. Your personal data will only be processed in data centers and on computers protected by security technologies that comply with industry standards (e.g., firewalls, password protection, access controls, etc.).

Your interactive applicant file that forms part of the online application system is protected by a personal user name and password. We recommend that you use a password that is at least eight characters long and combines letters, numbers, and special characters. Your password can be changed at any time.
